warranties or guarantee with regard to information on this site (herein
referred to as TMS), including all implied warranties or guarantees.. In
no event shall we be liable for any special, indirect, or consequential
damages or any damages whatsoever resulting from loss of use, health or life
or income, whether in an action of contract, negligence, or other action,
arising out of or in connection with the use or performance of this
information. We are in no way responsible for the content of sites that
are linked, whether in user's messages, archived content, or advertisements.
We reserve the right to delete or refuse to publish/answer any questions,
solutions, or information submitted. We reserve the right to reproduce
any messages received and to edit them as we see fit. Terms subject to
change at anytime without notice. This agreement is governed by the laws of
Virginia, regardless of conflicts of laws. The courts of Pennsylvania shall
be the exclusive jurisdiction and venue for any claim between the parties,
who consent to the jurisdiction and venue of those courts.
II. The forums were created for support
discussion, questions, answers, etc. The user assumes all liability for use
and contents of messages, software, and all information posted to this
forum. Illegal activities, including, but not limited to the distribution of
pirated software may be reported to the
proper authorities. TMS,
nor any of its affiliated entities are responsible for messages submitted to
this forum by users. We reserve the right to bar users and remove messages
for any reason. Users hereby waive all proprietary rights of any kind in and
to the contents of their messages and specifically: (i) release TMS and all
affiliates from all liability and obligations whatsoever, and (ii) grant
each of the foregoing an unlimited right to use the contents of their
messages. All content, text or image, that is sent or uploaded to the site
becomes the property of TMS and may be reused at its discretion. Users
acknowledge that no confidential, fiduciary, contractually implied or other
relationship is created between users, TMS, and its affiliates.
Additionally, users must agree to a set of Bulletin Board Rules when
registering.

Please remember that we are not responsible for any messages posted. We
do not vouch for or warrant the accuracy, completeness or usefulness of any
message, and are not responsible for the contents of any message. You,
through your use of this service (as either guest or member) remain solely
responsible for the content of your messages, and you agree to indemnify and
hold harmless this website, it's webmaster, host, and their agents along
with the owners of The Mane Street with respect to any claim based upon
transmission of any message(s).
The messages express the views of the author of the message, not
necessarily the views of this bulletin board. Any user who feels that a
posted message is objectionable is encouraged to contact us immediately by
email or PM. We have the ability to remove objectionable messages and we
will make every effort to do so, within a reasonable time frame, if we
determine that removal is necessary.
You agree, through your use of this service (as either guest or member), that you will not use this
bulletin board to post any material which is knowingly false and/or
defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene,
profane, sexually oriented, threatening, invasive of a person's privacy, or
otherwise violates any law. You also agree not to use this service to
stalk or harass other people or groups of peoples, nor to make personal
attacks upon people (members of this website or not) in your postings.
Under no circumstances may you allege that any specific individual or
organization has done anything illegal, unethical or abusive, unless what
you're saying has been documented as fact in a court of law. If
you feel that you have been the recipient of any of the above, please
contact the administration. While The Mane Street is in no way
responsible for content of posters, we will be happy to review a complaint
and will remove offending material if we feel it is necessary. Please
include all necessary specific information regarding any complaint of
content on our website, since non of the staff are currently psychic.
When using this service to impart information, opinions, thoughts or advice,
please be courteous, polite and respectful of persons, regardless of whether
you agree with them or not. While The Mane Street encourages debate
and the exchange of diverse information and experiences, blatant nastiness
and comments or remarks that are deliberately inflammatory to specific
persons or groups will not be tolerated and will be considered
"trolling" and removed if deemed necessary by the administration.
This administration feels there is a difference between someone disagreeing
with, debating, arguing with and even attacking someone's information,
presented facts, or opinions, and attacking a poster personally.
(Personal attacks consist of comments directed at the poster, NOT the topic
at hand, and consist of name calling, insults to a specific poster's
intelligence or character ect.) The former is permissible, the latter
is not. Therefore, reports or posts complaining
about the former will be ignored, and if they continue, will be removed.
Complaints about the latter will be attended to as quickly as possible by
whatever staff is online.
While the administration understands that sweeping, stereo-typical,
all-encompassing statements are not popular, please do not take them
personally, but rather as the overly simplified exaggerations that humans
are prone to.
If, for any reason, the staff feels that there is a problem on a thread
and issues a warning post or other instructions, please respect the
instructions of your moderators. If you have a concern, address it
in email, NOT on the board. When instructions are ignored, threads will be
shut down. If you don't follow the rules, your membership will be
revoked. The decisions of your moderators are final.
You agree to give up privacy
rights to any comments or opinions you post publicly on this Bulletin Board.
This is a public BB, viewable by the general public, and all postings on the
board will be considered usable and repeatable by the public, therefore it
is suggested that one keeps this in mind when posting.
We reserve the right to reveal your identity (or whatever
information we know about you) in the event of a complaint or legal action
arising from any message posted by you.
You agree not to post any copyrighted material unless the copyright is
owned by you or by this bulletin board.
You agree not to post advertisements of websites in direct competition
with TMS unless approved by the administration. Competitive sites are equine
specific sites containing classifieds, forums, articles and business
listings (paid or unpaid) or any combination thereof.
Unless a picture belongs to you or is obviously in the public domain
(celebrities, people in the news, CEO's of businesses, politicians,
disseminated jokes, public domain website pictures), please do not post them
without permission of the owner. Personal pictures of other individual,
animals, or property, for comment or discussion posted without owner's
permission will be removed as soon as
we become aware of them.
**RULES SPECIFIC TO THE CLASSIFIEDS**
Businesses are not permitted to post in the Personal Classifieds. Posts
in the Personal Classifieds that fall under the "business classification" may
be deleted without warning. Definitions for a business and restrictions for
ALL persons posting in the Personal Classifieds is as follows:
*Someone that buys or offers for sale more than two horses per year,
*Buys or offers for sale three or more saddles per year,
*Receives compensation for stallion services
*Receives compensation for training
*Receives compensation for lessons
*Receives compensation for boarding
*Receives compensation for services rendered.
*Has more than three pregnant or lactating mares in their possession.
*Offers to make available a product or products, either hand-made or
commercially made, for continuos sale to the public.
*Has a website or physical address that advertises equine sales or any
equine service
*has advertising on any website or physical publication for equine sales
or services
*Whether or not someone actually possesses a business license is not a
factor.
*Making a profit is not a factor.
**If you feel that you have extenuating circumstances that may exempt
you from the Personal Classifieds rules, or if you are unsure as to whether or not you fall
under these rules, please contact the administration FIRST, BEFORE posting
an ad, or it may be removed without warning!**
These rules were designed to give users an
understanding by which to
conform their conduct while participating on the Board. The Administration,
in its discretion has final say as to the specific action to be taken, if
any, for violations of rules. Further, although
this Bulletin Board cannot review every message posted and is not
responsible for the content of any of these messages, the Administration reserves the right
to close or delete any thread or post that it deems unacceptable for any or
no reason whatsoever, regardless of whether such thread or post violates a specific rule
or rules.
Violations of these rules will result in a member's posting abilities
being restricted or banned as deemed necessary by the administration, with
or without warning.
